Registration of Title
The new Land Register of Scotland is gradually replacing the old Register of Sasines.
In the new Register all title is shown relative to a map and, for an estate,
it confers the advantage that future sales or transfers are much simplified and less costly.Under the present rules applications for registration of title
are generally restricted to properties which change hands "for a consideration" and,
because of their complexity of title, few estates have yet been accepted for voluntary registration.Either way, registration of an estate title would require many hours of research of the public
Registers by the staff of the Registers of Scotland.
Moreover, because that research is limited to the public records, it is an almost impossible task.However, the nascent political interest in land reform has led to proposals that all estates
should be shown on a nationally available map; possibly produced from the Land Register
after encouraging estates to register title voluntarily and earlier than current rules allow.Whether the rules are changed or not, all applications for first registration would need to be supported
by all the maps and detailed information such as are produced by a
Landownership Survey
and, because the indexes produced by a Landownership Survey are cross-
referenced to the public Registers, the task facing the staff of the Registers of Scotland becomes feasible.
All that they would then require is the Landownership Survey results
together with access to the estate records so that the detail can be checked to their satisfaction.
